QUEENS DWI ARRESTS

The usual way that people are arrested for a DWI in Queens is being pulled over by the NYPD because of an alleged traffic infraction or accident. The police officer will then allege that you have an odor of alcohol on your breath and demand that you take a breathalyzer test. These machines that the NYPD uses are old, unreliable and based on faulty science.

If the machine says that you have blown over the .08 limit you will be charged with drunk driving and be placed before a judge for an arraignment. At the arraignment if this is your first arrest you will usually be released to appear on a future court date. It is also at this arraignment, that the Court will suspend your license and require that you do not drive until the NY DMV allows you to.

If you have refused a breathelyzer, you will be required to attend what is called a refusal hearing. If the judge finds against you at the hearing your license will be suspended for one year.
